Threat

Threat is a crime or fault, that consists in future illegal action that is possible, imposed and determined with the means of causing fear or uneasiness to the threatened individual.

Real Life case

I have a neighbor who has it against me because of the high volume of my music according to him.

Every time I turn it on, he rings my doorbell uninterruptedly. If I’m having a party, he always calls the police.

The other day in the lobby he told me that next time I threw a party he wasn’t going to call the police, instead he would burn my apartment. He’s crazy. Do I need a criminal lawyer? I want to denounce him, but I’d prefer if you pressed charges. My phone number is … please answer back.

Threats must be believable, and also may consist in threatening an illicit evil that may or may not be an act punished by law.

The bad action has to be possible, meaning that the person receiving this action must have reasons to believe it can happen. The imposing of this action means that the threatened has no control of the events that this may unleash, so the culmination of these acts depend only in the active person.

The action must have a clear social repulsion. Finally the determination is proved by the certain expression of the action. A threat’s means is to cause restlessness in the threatened pushing him into a state of fear.

The legally protected right is the freedom of the people involved and their right for peace and tranquility.

Threat is a crime of result. (the bad action that the threat is based in has to be known by the threatened) .

The essential nucleus on which this crime is based is the action of announcing a future bad event with actions, attitudes or words.

The crime of threat is valued taking in consideration the people, actions and circumstances surrounding the case.

The specific pain leads to an unequivocal will to practice a malicious pressure against the passive character that leads to a premeditated plan to terrorize the victim (passive character).

A threat crime may consist in threatening to cause a bad action that is a crime in itself (against life, personal integrity, or patrimony) , or the threat may consist in causing a bad action on something that does not lead to a crime.

There is also the distinction of conditional threat, which is the one that demands a certain quantity or condition to not continue to carry out the threat, there lays the condition.

In case of a threat that its action does not constitute a crime, this one is only considered a threat on itself when it is a conditional one. This then is considered blackmailing.
